“Discourage litigation. Persuade your neighbors to compromise whenever you can. As a peacemaker, the lawyer has superior opportunity of being a good man. There will still be business enough.”
What is Mediation?
Mediation is a private and confidential process in which an impartial/neutral person who is not involved in your dispute (the Mediator) encourages and facilitates communication between parties who are engaged in conflict. The Mediator’s job is to promote resolution of your dispute or your lawsuit, and to preserve the parties’ honor, respect, and dignity.
The desired end result is a full and final settlement on terms adopted entirely by the parties, and the avoidance of a scenario in which – after an ugly and divisive Courtroom battle – a Judge or jury decides the parties’ fates.
Why Choose Mediation?
A successful mediation saves time, money, headaches, and heartache. Mediation should not be confused with Arbitration, in which an impartial/neutral third party (or parties) acts as Judge and jury for your dispute, and tells you — in a final and binding ruling — how your dispute will be resolved. The best outcome at the conclusion of mediation is a full and final settlement of all claims and disputes, fashioned by the parties. The worst outcome is that nothing is resolved: The Mediator declares an impasse, and the parties move forward with litigation as if the mediation had never occurred.
